Terms and Conditions

  1. It is the Customer’s responsibility and expense to provide an Internet connection.
  2. The Customer agrees to allow Mark VII to collect and analyze customer’s data for purposes of improving quality and service, analyzing industry trends, and marketing Mark VII products. Mark VII agrees not to disclose Customer’s name or business name without prior written permission.
  3. Mark VII will make its best effort to ensure proper functioning of Mark VII Plus but cannot guarantee system availability or data accuracy.
  4. The Customer agrees that Mark VII shall not be held liable for any loss of revenue or profit, loss of use of equipment or functionality, interruption of business, downtime cost, loss of goodwill, loss or corruption of data, or any consequential, incidental, indirect, special, or punitive damages. The Customer is responsible for mitigating its damages and for backing up data stored in connection with Mark VII Plus.
  5. Mark VII agrees to provide the Customer with the capability to remotely reset Mark VII carwash systems owned by the Customer at the Customer’s request. Customer warrants that it will undertake all reasonable efforts to ensure prior to initiating a reset that (a) all persons exit the car wash bay, (b) the bay doors are closed or the Customer otherwise verifies that the bay is secure from unwanted entry, and (c) the path of travel of the car wash machine is unobstructed.
  6. The Customer shall indemnify and hold harmless Mark VII from and against all claims brought by a third party, including legal costs, due to personal injury or damage to the third party's tangible property, to the extent such claims are related to or caused by negligence of the Customer in connection with the operation of the car wash equipment’s remote reset capability. This agreement is in addition to the Indemnification in Section 8 of the General Terms of Sale for Direct Sales of Mark VII products, which remains in effect.
